Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Share the Snaps, including our website, album-sharing features and related services (collectively, the “Service”). By creating an account, creating or joining an album, uploading content, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. About Share the Snaps

Share the Snaps allows adults to create photo and video albums and invite others to view, upload and download content through shared links, QR codes and optional PINs. Albums are intended for families, teams, events and other private groups. Access depends on how album owners and participants handle their links, QR codes and PINs.

2. Eligibility

You must be at least 18 years old and legally able to enter into an agreement to create an account or contribute content. The Service is not directed to children under 13. Children may not create accounts or independently upload content.

By using the Service, you confirm that you are at least 18, the information you provide is accurate, you have authority to agree to these Terms, and your use complies with applicable law. Parents, guardians and other authorized adults may upload appropriate media containing children when they have the right or appropriate permission to do so.

3. Accounts

You are responsible for providing accurate information, keeping login credentials secure, activity performed through your account, promptly notifying us of suspected unauthorized access, and keeping your contact information current. You may not share credentials, impersonate another person or create an account for fraudulent, abusive or unlawful purposes.

4. Albums, Links and PINs

Album owners control who receives an album’s link, QR code and PIN. Anyone with valid access information may be able to view, upload or download album content. You are responsible for sharing access information only with appropriate people.

Do not treat an album link or PIN as a guarantee of complete confidentiality. If it is forwarded, additional people may gain access. Album owners are responsible for choosing settings, distributing access carefully, reviewing contributed content and downloading content they wish to preserve.

5. User Content

“User Content” means photos, videos, album names, captions, comments and other material submitted through the Service. You retain ownership of your User Content. Share the Snaps does not claim ownership of uploaded photos or videos.

By uploading User Content, you confirm that you own it or have permission to share it; it does not violate another person’s privacy, publicity, copyright or other rights; you have obtained any permission reasonably necessary for images or recordings of other people; and it complies with these Terms and applicable law.

6. Permission to Operate the Service

You grant Share the Snaps a limited, nonexclusive, worldwide, royalty-free license to host, store, copy, process, transmit, display and make your User Content available only as reasonably necessary to operate the Service; display content to authorized participants; create previews; enable uploads and downloads; maintain security and backups; troubleshoot problems; enforce these Terms; and comply with law.

This license does not permit us to use your media in advertising, social media or promotional materials without separate permission. It ends when content is deleted from active systems, except for temporary backup copies, security records and information retained for legitimate legal or operational reasons.

7. Prohibited Content and Conduct

You may not upload, store or distribute content that is illegal, fraudulent, threatening, exploitative or abusive; sexualizes, exploits or endangers a minor; contains child sexual abuse material or nonconsensual intimate imagery; promotes violence or credible threats; harasses, stalks or invades privacy; infringes intellectual-property rights; contains malware; impersonates another person; or violates a court order or legal obligation.

You also may not access albums or accounts without permission; circumvent limits or security controls; scrape or systematically download the Service; interfere with security; use unauthorized automation; resell the Service; send spam; consume excessive storage to disrupt the Service; or help someone engage in prohibited conduct.

8. Content Involving Children

Share the Snaps is designed for adult organizers, parents, guardians and invited adult contributors. If you upload content containing a child, you represent that you have the right or appropriate permission to share it with the intended album participants.

Parents and legal guardians may request review or removal by contacting admin@sharethesnaps.com. We may restrict content while a safety or privacy concern is reviewed.

9. Reporting and Removal

If you believe content violates these Terms, infringes your rights or was uploaded without appropriate permission, email admin@sharethesnaps.com with your contact information, the relevant album link, a description of the content, the reason for the request, your relationship to the person or rights involved, and enough information for us to locate it.

We may remove or restrict content, preserve evidence, suspend access, contact the album owner or take other reasonable action. We may request additional information to prevent fraudulent or abusive removal requests.

10. Copyright Complaints

If you believe copyrighted material was uploaded without authorization, email us with identification of the work and material, its location, your contact information, a good-faith statement that the use is unauthorized, a statement that your notice is accurate, your signature, and confirmation that you are the owner or authorized representative. We may remove allegedly infringing content and suspend repeat infringers.

11. Storage, Upload and Retention Limits

Accounts and albums are subject to limits displayed within the Service or on our pricing page. During the free beta, albums are generally retained for up to 90 days, storage and upload limits apply, limits may change, and features may be added, changed or removed.

We may reject uploads, limit storage, remove expired content or prevent additional uploads when limits are reached. Users are responsible for keeping original copies.

12. Expiration, Deletion and Backups

Share the Snaps is not intended to be the only permanent copy of your media. Content may be deleted when an album expires, an owner deletes it, an account is closed, limits are exceeded, content violates these Terms, the Service is discontinued, or deletion is reasonably necessary for security or legal compliance.

Expiration notices are a convenience and are not guaranteed. Deleted content may remain temporarily in backups, security logs or disaster-recovery systems. Always retain your originals and download anything you wish to keep before an album expires.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. Uploaded media may be visible and downloadable by people who possess the applicable album access information.

14. Beta Service

Share the Snaps is currently a beta service. Features may be incomplete, change without notice or experience errors. Uploads, downloads, playback and notifications may fail or become unavailable. We may modify, suspend or discontinue a beta feature or the beta program. When reasonably possible, we will provide notice before changes likely to result in content deletion.

15. Paid Services

Paid subscriptions are not currently available. If introduced, pricing, billing periods, storage allowances, cancellation and renewal terms, and any refund policy will be shown before purchase. Additional checkout terms may apply, and these Terms and the Privacy Policy will be updated as necessary before processing subscription payments.

16. Suspension and Termination

You may stop using the Service and request account deletion at any time. We may restrict, suspend or terminate access when we reasonably believe these Terms were violated; an account presents a security or legal risk; content may harm another person; use is fraudulent, abusive or disruptive; suspension is required by law; or the Service is being discontinued.

When appropriate, we may provide notice and an opportunity to correct an issue. Immediate action may be taken to protect users, children, the public or the Service. Termination may result in deletion of albums and User Content.

17. Third-Party Services

The Service relies on third-party providers for hosting, authentication, databases, file storage and email. We are not responsible for third-party services outside our control. Their outages, changes or security incidents may affect the Service.

18. Service Availability

We aim to keep Share the Snaps available and reliable but do not guarantee uninterrupted or error-free operation. Maintenance, security incidents, vendor outages and internet disruptions may temporarily affect access. We are not responsible for losses caused by a user’s failure to retain originals.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Share the Snaps disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. We do not guarantee that content will never be lost, every transfer will succeed, albums will remain available indefinitely, unauthorized access will never occur, or the Service will meet every requirement.

20. Limitation of Liability

To the fullest extent permitted by law, Share the Snaps and its operator will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or access arising from use of the Service. To the fullest extent permitted by law, total liability for claims relating to the free beta Service will not exceed $100. These limitations do not apply where prohibited by law.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Share the Snaps and its operator from claims, damages, losses and expenses arising from your User Content; use or misuse of the Service; violation of these Terms or another person’s rights; or unauthorized sharing of album access information. This does not apply to the extent a claim results from Share the Snaps’ own unlawful conduct.

22. Governing Law

These Terms are governed by California law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, unresolved disputes will be brought in state or federal courts located in Santa Clara County, California. Before filing a claim, both parties agree to make a reasonable effort to resolve it informally through written notice.

23. Changes to These Terms

We may update these Terms as the Service develops. We will update the effective date and may provide additional notice when a change materially affects users’ rights or obligations. Continued use after revised Terms become effective constitutes acceptance.

24. General Terms

If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without permission. We may transfer these Terms as part of a merger, acquisition, financing, reorganization or sale. These Terms, the Privacy Policy and any feature-specific terms form the entire agreement regarding the Service.
